The United Nations Organization Mission of the Democratic Republic of Congo (MONUC) is mandated to ensure the protection of civilians, including humanitarian personnel, under imminent threat of physical violence.
.
An arrest warrant was issued against Nkunda for war crimes and crimes against humanity and insurrection but MONUC has done nothing about arresting him despite warning from  Human Rights Watch. "So long as Nkunda is at large, the civilian population remains at grave risk."
 


MONUC has around 17,000 peacekeepers, more than 90% of which are deployed in the east. The North Kivu Brigade has a current strength of between 5,000 and 6,000, spread across 34 locations. Around 1,500 are currently deployed in Goma. It has a robust Chapter VII mandate that authorizes it to use “all necessary means” -- including deadly force -- to protect civilians and humanitarian personnel under imminent threat of physical violence. The protection mandate includes the ability to proactively “deter any attempt at the use of force to threaten the political process from any armed group, foreign or Congolese, particularly in the Eastern part of the Democratic Republic of the Congo, including by using cordon and search tactics to prevent attacks on civilians and disrupt the military capability of illegal armed groups that continue to use violence in those areas” (UNSC Resolution 1794).

Laurent Nkunda is a war criminal. The Congolese government issued an international arrest warrant against him for war crimes in 2005. Human Rights Watch has been calling for his arrest for war crimes since February of 2006.
 
 
He is on a UN Sanctions List for breaches of the UN arms embargo in the DRC. On October 31, 2006 U.S. President George W. Bush signed Executive Order 13413 freezing his assets for contributing to the conflict in the Congo
